A Kissimmee woman claims her new-home dreams have been shattered by an Orlando builder.
Action 9 found she’s not the only buyer who paid for a house they can’t move into.
“I don’t even know what this is,” said Sheyla Lopez.
It should be home sweet home but it’s just slab and cinder block. She was supposed to move in in August 2014, “And no home yet, and I want this over and done with,” she said.
Lopez signed a contract with KCV Associates 16 months ago. She’s been paying a construction loan and insurance ever since.
“I have no communication with the company,” said Lopez.
According to the contract, if the home wasn’t finished in 180 days, the builder owed the buyer a $50 penalty every day it’s late.
Lopez said KCV hasn’t paid a dime but a subcontractor just filed a lien against her because KCV didn’t pay for material. She said she was beyond surprised.
“Oh, my God. I had to contact my lawyer. What do I do now?” she said.
KCV Associates is rated F at the Better Business Bureau, and most complaints involve service problems.
Attorney Josue Merino with the Sanchez Law Group represents two other buyers who don’t have homes.
“To date, we haven’t had a solution and that’s taken us to the next step which is legal action,” said Merino.
Action 9’s Todd Ulrich caught up with KCV Associates co-owner Cody Vandegrift.
“I’m here about Sheyla Lopez. I’ve seen her contract,” said Ulrich.
Cody did not reply but his partner, Richard Rivera, said, “Cody is in a meeting. I take care of that.”
Off camera, Rivera said Lopez’ property was in a flood zone, and that caused delays. He said the company has 230 customers but only a handful of customers have problems.
He said Lopez’s construction will now be completed in four months.
“I do not want any pity. Just comply to what the contract says,” said Lopez.
The builder claims he doesn’t owe penalties, because the delays were caused by unforeseen complications.
Lopez also filed a complaint with state licensing regulators.
